Terms of Use
Last updated 13 October 2026
These Terms of Use ("Terms") are an agreement between you and New Version Limited, a company registered in New Zealand ("we", "us", "our"). They cover your use of NovelGPT on iOS, Android, macOS and the web at novelgpt.app, and any related services (together, the "Service").
By using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refunds & Cancellation policy. If you do not agree, please do not use the Service.
Your legal rights. Nothing in these Terms limits any right you have under consumer law that cannot be excluded by contract. This includes the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law, and the consumer laws of the EU, the UK and other countries.
Who can use NovelGPT
You must be at least 18 years old, and legally able to enter into this agreement, to use the Service.
If you use the Service on behalf of an organisation, you confirm you are allowed to accept these Terms for it.
Your account
- Guest account. The first time you open the app, we create a guest account for you with a random account ID. No email or sign-in is needed.
- Signing in is optional. You can sign in with Apple, Google or an email code to keep your credits and purchases across devices and to sync your books.
- Keep it secure. You are responsible for what happens under your account and for keeping your devices and sign-in methods secure. Tell us at support@novelgpt.app if you think someone else has used your account.
- Guest books. A guest's books are stored only on that device. If you delete the app, clear browser data or lose the device without signing in, those books cannot be recovered. Export them regularly.
- Inactive guest accounts. A guest account that has never bought anything and is not used for 180 days may be deleted.
Licence to use the Service
We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for writing, under these Terms. We and our licensors own the Service, including its software, design and branding, and keep all rights not expressly given to you.
You must not:
- copy, modify, sell or resell the Service;
- reverse engineer the Service, except where the law allows it despite this restriction;
- get around credit limits, rate limits or access controls;
- access the Service with automated tools, except through the app's normal features;
- use the Service in a way that breaks the law or our Acceptable Use Policy.
Your content
You own your writing. Everything you write or upload (your "Content") remains yours. We claim no ownership of it.
Our licence to your Content. To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and transmit your Content, only so we can:
- provide the features you use, including sending text to AI providers when you ask for an AI action;
- sync your books between your devices if you sign in;
- keep the Service secure.
This licence ends when you delete the Content or your account, except for copies we must keep by law. We do not use your Content to train AI models, and we do not sell it.
Your responsibility. You confirm you have the rights to the Content you put into the Service, and that it does not infringe anyone else's rights or break the law.
AI output
- You may use AI output. As between you and us, you own the text the AI produces for you ("Output"), and you may use it for any lawful purpose, including publishing and selling your book. We assign to you any rights we may have in the Output.
- Copyright is not guaranteed. Copyright law on AI-assisted writing differs between countries. We cannot promise that Output can be protected by copyright or registered, or that it is unique: the AI may give similar text to other people.
- AI makes mistakes. Output may be inaccurate, inconsistent, offensive or similar to existing works. It is not professional advice. Review and edit Output before you rely on it or publish it. You are responsible for what you publish.
- The AI comes from other companies. AI models are run by third-party providers (currently Anthropic, OpenAI, Google and xAI). Their availability, behaviour, and the list of models we offer can change.
- Report harmful output. You can report harmful Output with the Report action in the app, or by emailing support@novelgpt.app.
Credits
AI actions use credits.
- Cost shown first. Each AI action shows an estimate of its credit cost before you confirm it. The final cost depends on how much text is read and written, so it can differ slightly from the estimate.
- Free plan. The Free plan includes a monthly allowance of credits that works with selected models and effort levels. Premium models and effort levels need purchased credits or a paid plan.
- Plan credits. Plan credits renew each billing month. Unused plan credits do not roll over, including on yearly plans, where credits are given monthly.
- Pack credits. Credits from one-time credit packs do not expire while your account and the Service exist. Plan credits are used before pack credits.
- Not money. Credits are a licence to use the Service. They have no cash value, cannot be exchanged for money (except where refund law requires), and cannot be transferred, sold or gifted.
- Negative balance. If a purchase is refunded or reversed after its credits were used, your balance can go negative. Later credits pay it back first.
- Limits. We may limit free credits, new accounts or usage rates to prevent abuse and keep costs fair.
Prices and what each plan includes are listed on our Pricing page and in the app.
Subscriptions and purchases
- Where you buy decides the rules. On iOS and macOS you buy through Apple's App Store, on Android through Google Play, and on the web (when available) through our payment processor Stripe. That store or processor takes the payment, and its terms also apply.
- Auto-renewal. Subscriptions renew automatically at the end of each period (monthly or yearly) at the then-current price, unless you cancel at least 24 hours before the period ends. Payment is charged to your store account at confirmation of purchase and at each renewal.
- Cancelling. Cancel in your App Store or Google Play account settings, or, for web subscriptions, through the link in your receipt or by emailing us. Cancelling stops future renewals. Your plan stays active until the end of the period you paid for.
- Changing plans. Upgrades take effect immediately. Downgrades take effect at your next renewal.
- Price changes. We may change prices for future periods. We will give you advance notice, as the store or the law requires, and you can cancel before the new price applies.
- Refunds. See our Refunds & Cancellation policy. Refunds for App Store and Google Play purchases are handled by Apple and Google.
- Taxes. Prices may include or add taxes such as GST or VAT, depending on where you are and where you buy.
Early access and changes to the Service
- Early access. Some features, models, or the AI itself may be available only to people we invite, for example during a private testing period. Access codes are personal and must not be shared.
- Changes. We are continually improving the Service. We may add, change or remove features or AI models. If a change materially reduces a paid feature you are currently paying for, we will tell you in advance where practical, and you may cancel.
Third-party services
The Service relies on other companies, including app stores, payment processors, AI providers and hosting providers, and links to their websites. We are not responsible for their services, and their terms and privacy policies apply to your use of them.
Ending your use
- You can stop at any time. You can stop using the Service and delete your account in the app; see Delete your account. Deleting your account does not cancel a store subscription, so cancel that in your store account too.
- We can suspend or close accounts if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if the law requires us to, or to protect other users or the Service. Where reasonable, we will tell you first and give you a chance to export your books.
- If we close the Service. We will give at least 30 days' notice where possible, so you can export your books. If we end the Service for reasons other than your breach, we will refund unused, paid-for pack credits and the unused part of a prepaid subscription period, where we received the payment or the law requires it.
The sections on your content, AI output, disclaimers, liability, indemnity and governing law survive the end of this agreement.
Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that:
- the Service or any AI model will always be available, uninterrupted or error-free;
- AI output will be accurate, original or fit for a particular purpose;
- data stored only on your device can be recovered.
Keep your own backups of important work.
Nothing in this section excludes guarantees you have under consumer law. For example, if you are a consumer in New Zealand, the Consumer Guarantees Act 1993 gives you guarantees that cannot be excluded.
Limitation of liability
To the extent the law allows:
- No indirect losses. We are not liable for indirect or consequential loss, loss of profits, revenue, data or goodwill, or for losses caused by events outside our reasonable control.
- Overall limit. Our total liability for all claims about the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or NZ$100.
These limits do not apply to liability that cannot legally be limited, such as liability for fraud, for death or personal injury caused by negligence, or under consumer guarantees that cannot be excluded.
Business users. If you use the Service for the purposes of a business, the Consumer Guarantees Act 1993 does not apply, and you agree that it is fair and reasonable for sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 not to apply either.
Indemnity
If you use the Service for business purposes, you agree to cover our reasonable losses and costs from third-party claims arising from your Content or from your breach of these Terms or the law. This section does not apply to consumers where the law does not allow it.
Governing law and disputes
- Governing law. These Terms are governed by the laws of New Zealand.
- Courts. Disputes go to the courts of New Zealand. If you are a consumer, you can also bring proceedings in the courts where you live, and you keep the protection of the mandatory consumer laws of your country.
- Talk to us first. Before starting any formal claim, please email support@novelgpt.app so we can try to resolve it informally.
App Store and Google Play terms
If you got the app from Apple's App Store, you and we agree that:
- these Terms are between you and us only, not Apple, and we, not Apple, are responsible for the app and its content;
- your licence to the app is limited to use on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any). To the extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses or costs from a failure to meet a warranty are our responsibility under these Terms;
- we, not Apple, are responsible for any claims by you or a third party about the app or your possession or use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims;
- if a third party claims the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim;
- you confirm you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties;
- you must also comply with any applicable third-party terms when using the app;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
Apple's Licensed Application End User License Agreement also applies to the extent it does not conflict with these Terms.
If you got the app from Google Play, the Google Play Terms of Service also apply to your download and purchases. Google is not responsible for the app.
Changes to these Terms
We may update these Terms. We will change the "Last updated" date and, for significant changes, tell you in the app or by email before they take effect. If you keep using the Service after a change takes effect, you accept the new Terms. If you do not agree, stop using the Service and cancel any subscription.
General
- Entire agreement. These Terms, together with the policies linked from them, are the whole agreement between you and us about the Service.
- Severability. If any part is found unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a right, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of our business, with notice to you.
- Language. These Terms are written in English. If a translation conflicts with the English version, the English version applies, unless your local law says otherwise.
